Terms and Conditions

Definitions

Buyer – is the individual or organisation who agrees to buy the goods from the seller.
Seller – is Gateremotes Ltd. Unit 57, Askern Industrial Estate, Moss Road, Askern, South Yorkshire DN6 0DD.
Goods – the articles that the buyer agrees to buy from the seller.

The Terms and Conditions do not affect the buyer or sellers statutory rights and shall apply to all contracts for the sale of goods by the seller to the buyer.

Acceptance of delivery of the goods will be deemed conclusive evidence of the buyers acceptance of these Terms and Conditions. Any variation shall be inapplicable unless agreed in writing by the seller.

Ordering

All orders for goods shall be deemed to be an offer from the buyer pursuant to these Terms and Conditions and are subject to acceptance by the seller. The seller may choose not to accept an order for any reason.

If the goods are not available from stock, the buyer will be given the option to wait until available or to receive a full refund.

Price and Payment

The price of the goods shall be that stipulated on the seller`s website. The price is inclusive of VAT and excludes delivery charges.

The total price including VAT and delivery charges will be displayed prior to confirming the order. Payment must be made in full prior to despatch of the goods.

The seller reserves the right to adjust the price and specification of any item on the website or to withdraw any goods at any time.

Warranty

The seller shall be under no liability arising from failure to follow the Sellers or the manufacturers instructions (whether oral or in writing), inappropiate storage, improper use, inadequate maintenance or misuse of the goods.

All goods supplied by the seller have a 12 month warranty.

All goods supplied by the seller have a warranty against manufacturing faults and defects. This warranty does not cover wear items that are listed in the operations guide related to the goods. If goods are damaged in transit it is the buyer`s responsibility to notify the carrier at point of signature and to notify the seller within 24 hours of delivery.

Delivery

Goods supplied within the UK will normally be delivered usually 2-3 working days from receipt of order.

Goods supplied outside the UK will normally be delivered within 21 working days of receipt of order.

The seller shall endeavour to meet agreed delivery dates, but in the event that dates cannot be met we will contact the buyer by email or telephone to arrange revised dates or refund.

Delivery of the goods shall be made to the buyer’s address specified in the order and the buyer shall make all arrangements necessary to take delivery of the goods whenever they are tendered for delivery.

Title and risk of the goods shall pass to the buyer upon delivery.

Upon delivery consignments should be checked immediately and any delivery shortages or transit damage should be reported within 24 hours of receipt. Gateremotes Ltd are unable to process a claim or replenish stock outside of this time period.

Cancellation and returns

If the goods are damaged or do not comply with any of the contract, the seller will give a full refund within 30 days of delivery provided that the goods are returned to us in their original condition and packaging with all accesories and your returns number.

The buyer has the right to cancel the contract and receive a refund by informing us in writing or by email within 7 working days of receipt of the goods. Goods must then be returned at the buyers cost and a refund will be given within 30 days. Should the goods be found to be damaged due to the buyers fault, the buyer will be liable for this cost.

If you need to return goods to us for whatever reason a returns number must be allocated by GateRemotes. Contact our team with your invoice number and reason for return, and a returns number will be allocated which must be included with your returned item. Goods sent back without a returns number will not be processed.

Products returned for credit will be subject to a 15% restocking fee.

Postage costs will not be refunded, unless agreed with GateRemotes Ltd.

Liability

Nothing in these Terms and Conditions shall exclude or limit the liability of the seller for death or personal injury resulting from the negligence of the seller under this contract shall prejudice its rights to do so in the future.

The seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances beyond its control: acts of God, strikes, lock outs, accidents, war, fire, breakdown of machinery, shortage or unavailability of materials.

Privacy Statement

The seller is committed to protecting the buyer’s privacy. The seller will only use the information that collected lawfully in accordance with the Data Protection Act 1998. The seller will not retain any credit details in clear text on any website Consumer Protection (Distance Selling) Regulations 2000

We do not store credit card details nor do we share customer details with any 3rd parties.
